This Disclaimer applies to the content of itskooly.com and the Beats, demos, and other materials we make available through it. It complements, and must be read together with, our Terms of Service, License Agreement, and Refund Policy.

We publish this document in English and Spanish and both versions are equally authentic. In case of inconsistency between the two versions, the Spanish version shall prevail for consumers domiciled in Chile; the English version shall prevail in all other cases. Nothing in this clause limits the non-waivable statutory rights of a consumer under the law of their country of habitual residence.

1. Informational purposes

The content of itskooly.com — including text, audio previews, images, descriptions, and any tips or recommendations — is provided for general information and promotional purposes. It does not constitute legal, financial, commercial, or any other kind of professional advice. Before making decisions based on what you read on the Site, you should verify the information with a qualified professional.

2. Production use and your responsibility

Beats are audio works intended for creative production use under the License Agreement. You are responsible for:

  • Ensuring that your use of a Beat complies with the tier you purchased.
  • Obtaining any additional clearances required by third parties (samples, features, guest performances, cover art, visual elements) that are outside our control.
  • Complying with all applicable laws — including copyright, advertising, broadcasting, and consumer-protection laws — in the territory where you use the Beat.

We do not monitor or approve the content you create using our Beats. You are solely responsible for the lyrics, visuals, and context in which you distribute them.

3. Scope of the license

The rights you obtain over a Beat are limited to what is expressly granted in the tier you purchased, as described in the License Agreement and the per-order contract PDF. Any use outside that scope — in particular the prohibited uses listed in §7 of the License Agreement — is not authorized and may lead to revocation under §11 of that Agreement.

If in doubt about whether a specific use is covered, write to kooly@itskooly.com for a clearance decision before you use the Beat.

4. No warranty

To the maximum extent permitted by applicable law, the Site and the Beats are provided "as is" and "as available", without warranty of any kind, whether express or implied. We do not warrant that:

  • The Site will be uninterrupted or error-free.
  • Any Beat will meet your particular creative or commercial expectations.
  • The results of using a Beat will produce any specific level of streams, sales, or engagement.

This section does not exclude or limit any warranty that applicable law does not allow to be excluded or limited. The warranty of title set out in §12 of the License Agreement remains in force.

The Site may link to third-party websites, services, or integrations (for example, MercadoPago, streaming platforms, social networks, reference articles). We do not control those destinations, we do not endorse their content, and we are not responsible for their availability, accuracy, or privacy practices. When you follow an external link, you leave our Site and become subject to the terms and privacy policies of the destination.

6. Limitation of liability

The limitation-of-liability and consumer-carveout provisions in §12 of the Terms of Service apply to any liability that might otherwise arise from the content covered by this Disclaimer. In summary:

  • Our total liability to you is capped at the amount you paid us in the twelve (12) months before the event.
  • We are not liable for indirect, incidental, consequential, or punitive damages.
  • Nothing in this Disclaimer limits the non-waivable rights of consumers under Chilean Ley 19.496 or under EU consumer law, nor liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

7. Changes to this Disclaimer

We may update this Disclaimer at any time. The "last updated" date at the top reflects the most recent revision. Material changes take effect no earlier than 30 days after we publish them, unless applicable law requires otherwise. Use of the Site after that date constitutes acknowledgment of the updated text.
