This Legal Notice identifies the natural person responsible for itskooly.com and how to contact them for legal, data-protection, and consumer-law matters. It is published in compliance with Chilean Ley 19.496 (Ley del Consumidor), Ley 19.628 (on protection of private life), and the EU General Data Protection Regulation (GDPR) transparency duties.
We publish this document in English and Spanish and both versions are equally authentic. In case of inconsistency between the two versions, the Spanish version shall prevail for consumers domiciled in Chile; the English version shall prevail in all other cases. Nothing in this clause limits the non-waivable statutory rights of a consumer under the law of their country of habitual residence.

3. Role under data-protection laws
For personal data processed through itskooly.com, José Chrystian Soria Diaz acts as:
- Data controller under the EU General Data Protection Regulation (GDPR), including for visitors outside the European Union, because we offer services to users located in the EU.
- Responsable del tratamiento under Chilean Ley 19.628 and its successor legislation, for all personal data collected from users domiciled in Chile or otherwise reached by Chilean law.
Our processing activities, legal bases, sub-processors, retention periods, and user rights are described in the Privacy Policy. Our use of cookies and similar technologies is described in the Cookie Policy.
4. Jurisdiction and applicable law
itskooly.com is operated from Chile. The Terms of Service are governed by the laws of Chile, with the consumer carveouts described in §15 of the Terms of Service. Commercial disputes are submitted to the competent courts of Santiago de Chile. Consumers keep the right to bring proceedings before the courts of their country of residence where applicable law so requires, and to use any alternative dispute-resolution mechanism offered by their national consumer authority, including the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
5. Complaint mechanism
If you believe we have mishandled your personal data or breached your rights as a consumer, please contact us first at kooly@itskooly.com so we can try to resolve the matter. You may also:
- File a complaint with the data-protection authority of your country of residence (in the European Union, the list is at edpb.europa.eu).
- In Chile, contact SERNAC for consumer matters and the data-protection authority designated by law for data-protection matters.
- Use the EU Online Dispute Resolution platform linked in §4.
6. Hosting and technical infrastructure
itskooly.com is hosted by Vercel Inc. (United States), with database and authentication provided by Supabase Inc. (United States), file storage in Cloudflare R2 (United States), payment processing by MercadoPago (Chile), transactional and marketing email by Resend (United States), bot protection by Cloudflare Turnstile (United States), rate-limiting by Upstash (US or EU, region-configurable), and — only with user consent — analytics and session recording by Microsoft Clarity and Vercel Analytics (United States). 7. Changes to this notice
We update this notice whenever the identification, role, contact, or jurisdictional details change. The "last updated" date at the top reflects the most recent revision. We do not require your consent to update identification facts, but we will reflect any change in a subsequent version.
